Dispute Resolution, Chargeback, and Legal Terms
⚠️ LEGAL NOTICE - DISPUTE RESOLUTION POLICY ⚠️
The following terms govern all disputes, disagreements, chargebacks, and legal matters related to CR Fence & Rail products and services.
Limitation of Liability
Maximum Financial Obligation: CR Fence & Rail's total liability for any and all claims arising from the purchase, use, installation, or performance of our products shall not exceed the actual purchase price paid for the specific product(s) giving rise to the claim, excluding shipping, handling, taxes, and installation costs.
In no event shall CR Fence & Rail be liable for:
- Indirect, incidental, special, consequential, or punitive damages
- Lost wages, project delays, contractor fees, or business interruption
- Installer labor costs or "lost time" charges
- Property damage or personal injury resulting from improper installation
- Code violations or permit issues
- Any damages exceeding the purchase price of the products (excluding shipping)
Installation and Safety Disclaimer
All installations must be performed by licensed contractors in accordance with local building codes and permit requirements. CR Fence & Rail expressly disclaims any responsibility for:
- Injuries or property damage resulting from improper installation
- Failure to obtain proper permits or inspections
- Use of unlicensed installers or DIY installation errors
- Code violations or structural failures
- Any installation not performed in accordance with our Means & Methods Disclaimer
CRITICAL: Customers and installers assume all risk and liability for installation safety, code compliance, and structural adequacy. Following CR Fence & Rail's general guidelines does NOT constitute proper installation and does NOT transfer liability to CR Fence & Rail. Refer to means & method disclaimer.
Governing Law and Jurisdiction
Exclusive Jurisdiction: Any and all disputes, claims, or legal proceedings arising from the purchase, use, or installation of CR Fence & Rail products shall be resolved exclusively in the state courts of Clark County (Henderson), Nevada, under Nevada state law.
By purchasing CR Fence & Rail products, customer agrees to:
- Nevada jurisdiction regardless of customer's location
- Venue in Clark County (Henderson), Nevada for any legal proceedings
- Application of Nevada state law to all disputes
- Waiver of any objection to jurisdiction or venue in Nevada courts
No Class Actions: Customer agrees to resolve all disputes on an individual basis and waives the right to participate in class action lawsuits or class-wide arbitration.
Chargeback Policy - CRITICAL
Immediate Termination of Support:
IF A CHARGEBACK IS INITIATED, ALL CR FENCE & RAIL SUPPORT IMMEDIATELY CEASES.
The moment a chargeback is filed with your credit card company or payment processor:
1. ✅ We will immediately provide to the payment processor:
- Complete order history and timeline
- All communication records (emails, texts, phone logs)
- Shipping confirmation and tracking information
- Photo documentation from customer (if provided)
- This complete Pre-Installation Preparation Guide
- Our Terms of Service and all applicable policies
- Documentation of what we offered and what customer rejected
- Clear demonstration of policy compliance on our part
2. ❌ We will immediately STOP all customer support:
- No further technical assistance
- No replacement parts (even if legitimately defective)
- No returns or exchanges
- No communication except through legal channels
- All future orders from customer will be refused
3. ⚖️ The matter becomes a legal dispute:
- Customer service cannot help you
- This is now handled by our legal team and payment processor
- The chargeback process will determine the outcome
- Our policies will be provided as evidence
Why This Policy Exists:
A chargeback is a legal claim that CR Fence & Rail committed fraud or failed to deliver products/services. When you file a chargeback, you are making a legal accusation that must be resolved through formal dispute channels, not customer service.
Once a chargeback is filed:
- The relationship changes from customer service to legal dispute
- We must defend ourselves through the formal process
- Customer service is no longer the appropriate channel
- All communication becomes legal documentation
Outcome of Chargeback:
If Customer Wins Chargeback:
- Customer receives refund through payment processor
- Customer is permanently banned from future CR Fence & Rail purchases
- CR Fence & Rail retains the right to pursue legal action for any damages
- No further relationship with customer is possible
If CR Fence & Rail Wins Chargeback:
- Customer's claim is denied
- No refund is issued
- Customer is still permanently banned from future purchases
- Customer may still owe for products received
- CR Fence & Rail retains right to pursue collection if applicable
In Either Event: Once a chargeback is filed, the customer relationship is permanently terminated. There is no path back to normal customer service or support, regardless of the chargeback outcome.
Dispute Resolution Before Chargeback
BEFORE filing a chargeback, customers must:
- Contact CR Fence & Rail customer service with specific concerns
- Provide opportunity for CR Fence & Rail to resolve the issue per our policies
- Review this Pre-Installation Guide and all applicable policies
- Understand that our policies are final and cannot be overridden
Available Resolutions Short of Chargeback:
- Replacement parts for legitimate defects (per our policy)
- Financial compensation up to policy limits ($200 or 10%, whichever lower)
- Return and refund under our Return Policy terms
- Additional time to resolve issues if reported during proper timeline
If These Resolutions Are Unacceptable: Your option is to return the products under our Return Policy, not to file a chargeback. A chargeback should only be filed if CR Fence & Rail has genuinely committed fraud or failed to deliver products (overall, and not just as some parts missing and have failed to correctly send the correct product through our issue resolution policy) - not as leverage for policy disagreements.
Final Policy Statement
This Policy is Set and Final: The policies outlined in this document and our other policy pages are established and final. Our customer service team cannot escalate issues beyond what is stated here. There is no supervisor, manager, or other representative you can speak with to override these policies.
Pre-Order Acknowledgment Required: If any of these policies do not align with your expectations, please cancel your order and do not purchase from us. There is nothing that our staff or anyone in our company can do to modify these terms after purchase.
No Exceptions - No Overrides: This policy cannot be overridden by any representative, manager, or company official. The terms outlined here represent the complete and final scope of CR Fence & Rail's obligations and limitations.
By proceeding with your order, you acknowledge and accept:
- All terms in this Dispute Resolution and Legal Policy
- The Pre-Installation Preparation requirements
- Our Missing/Damaged Parts Policy limits
- Our Installer Lost Time Policy
- Our Chargeback Policy and its consequences
- Exclusive jurisdiction in Clark County (Henderson), Nevada
- These terms as final and binding
